Terms of sale

1. Who we are

Safeguarding Context is a service of Meddalwedd ("we", "us"). You can contact us at info@safeguardingcontext.co.uk. "You" means the school, trust, local authority or other organisation named on the order.

2. What you are buying

For each school on an order you receive, for 12 months from the day the order is delivered:

• the safeguarding context report for that school, as a PDF, made from the published data current when you download it;
• the one-page staff briefing for that school;
• access, for the account that placed the order, to that school's insight dashboard and action log.

When the 12 months end, the downloads, the dashboard and the action log close for that school. Keep a copy of anything you need beyond then: a report or briefing you have downloaded is yours to keep under section 5. We email a reminder a month before; renewing the school gives a further 12 months with that year's figures, and the action log is kept as it was. Nothing renews automatically.

Everything is supplied digitally. Nothing is posted. Your order is delivered when these are available in your account, which is normally as soon as payment is confirmed; if the figures for a school take longer to prepare, the order page says so and we email you when they are ready.

3. What the report is, and is not

The report gathers published public data about the surroundings of a school and the local authority it is in, sets it beside the requirements of the statutory safeguarding guidance, and suggests wording for the school's own documents. It is evidence to support the professional judgement of your designated safeguarding lead and leaders. It is not:

• a rating or assessment of the school, its staff or its pupils;
• legal, safeguarding or professional advice, or a substitute for your local safeguarding partnership, the police or your own records;
• a document any inspectorate requires, or a prediction of any inspection outcome.

The data comes from public bodies and from UK Crime Statistics. It can be incomplete, revised or delayed, and every report states the limits of each figure. You decide what, if anything, to use in your own documents.

4. Prices and payment

The current price is £149 per school for a year, the same for every school on an order. The price is shown before you place the order and is the price you pay. Payment is by card through our payment provider at the time of ordering. Where we have agreed in writing to invoice an order instead, the invoice is payable by bank transfer within 30 days of its date, and if it is not paid on time we may suspend access to that order's dashboards and action logs until it is.

5. Using what you receive

You may use the report, the staff briefing and the dashboard figures within your organisation for the school's safeguarding work, and share them with your governors, trustees, staff, inspectors, local safeguarding partners and advisers. You may copy the suggested paragraphs into your own policies and reports. You may not resell them, publish them as a service to others, or remove the source acknowledgements. The underlying public data remains under the licences stated in each report, usually the Open Government Licence.

6. If something is wrong

If a report cannot be produced for a school on your order, or contains an error that is ours rather than the source data's, tell us within 30 days of delivery. We will correct and reissue it or, if we cannot, refund what you paid for that school. Because reports are made and delivered digitally at your request, we do not otherwise offer refunds once an order has been delivered. A card order that has not been paid can be cancelled from the order page at any time.

7. Our responsibility to you

We supply the service with reasonable care and skill. Our total liability to you for any order is limited to the price you paid for it. We are not liable for any decision taken or not taken on the strength of a report, for the accuracy of the public data it draws on, or for any indirect or consequential loss. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud.

8. Your data

We handle the personal data needed to run your account and your orders as described in the privacy notice. The action log is for what your school does about its surroundings and arrangements; do not record anything about an individual pupil in it.

9. Changes and law

We may update these terms; the version in force when you place an order applies to that order. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
